These Terms & Conditions apply to services provided by Elevation Media Solutions ("we", "us", "our") to customers ("you", "your").
By ordering our services, you agree to these Terms & Conditions.
1. Our Services
Elevation Media Solutions provides property video creation services using photography and other materials supplied by the customer.
Our standard service includes the creation of cinematic property video content based on the agreed brief.
Specific deliverables, pricing, turnaround times and revisions will be confirmed before work begins.
2. Customer Materials
You are responsible for providing the photography, images, logos, branding and other materials required for your project.
You confirm that you have the necessary rights, permissions and licences to provide these materials to us and to authorise us to use them for the purpose of providing the services.
You must not provide materials that infringe another person's intellectual property, privacy or other legal rights.
3. Property Rights and Permissions
Where property photography or other content relates to a property, you confirm that you have permission to use and provide that material for the requested marketing purpose.
Elevation Media Solutions is not responsible for disputes arising from your lack of rights or permissions relating to materials you provide.
4. Pricing and Payment
Our current prices are displayed on our website or provided directly to you.
Unless otherwise agreed, payment is required before production begins.
Prices may change from time to time. Any change will not affect an order that has already been confirmed.
Additional work outside the agreed scope may incur additional charges.
5. Revisions
Our standard packages include the number of revisions specified in the relevant package.
A revision means a reasonable adjustment to the agreed video brief.
Requests for substantially different creative direction, additional scenes, additional versions or work outside the agreed scope may be charged separately.
6. Video Formats
Where included in your package, videos may be supplied in portrait, landscape, or both, as agreed.
Additional versions or formats outside the agreed package may incur an additional charge.
7. Turnaround Times
We will aim to complete projects within the turnaround time agreed with you.
Turnaround times may be affected by delays in receiving required materials, feedback or approvals.
Urgent or expedited work may be subject to an additional fee.
8. Artificial Intelligence and Creative Output
Our production process may use artificial intelligence and other digital tools.
While we make reasonable efforts to produce high-quality and commercially suitable content, AI-generated outputs can occasionally contain visual inconsistencies or inaccuracies.
You are responsible for reviewing the final video before publication and confirming that it is suitable for your intended use.
We will make reasonable corrections to issues that fall within the agreed revision allowance.
9. Accuracy of Property Representation
Our videos are intended for marketing purposes and are created from supplied photography.
Generated movement or visual effects may not represent every physical detail of a property with photographic accuracy.
You are responsible for ensuring that the final content does not make misleading claims about the property.
10. Approval and Responsibility
You are responsible for reviewing and approving the final video before publishing or distributing it.
Once you have approved the final version, responsibility for its publication and use rests with you.
11. Intellectual Property
Unless otherwise agreed in writing, you retain ownership of the original materials you provide to us.
Upon full payment, you receive the agreed right to use the finished video for your property marketing purposes.
Elevation Media Solutions retains ownership of its underlying production methods, workflows, templates, prompts, systems and other proprietary processes.
12. Portfolio and Promotional Use
We will not publicly display your property photography, videos or other project materials as portfolio work without your permission.
If you agree to us using completed work for promotional purposes, we may display the agreed materials on our website, social media or other marketing channels.
13. Cancellation
If you wish to cancel an order after production has started, you may be responsible for work already completed and any non-refundable costs incurred.
For recurring monthly services, cancellation terms will be agreed as part of the relevant subscription or service agreement.
14. Refunds
Because our services involve bespoke digital production, refunds are not automatically available once work has commenced.
Where a project does not meet the agreed brief, we will normally have the opportunity to make the included revisions before any refund is considered.
Nothing in these Terms & Conditions affects your statutory rights.
15. Limitation of Liability
We will provide our services with reasonable care and skill.
To the extent permitted by law, we will not be responsible for indirect or consequential losses arising from the use of our services.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
16. Third-Party Platforms
We are not responsible for changes, restrictions, outages or policies imposed by third-party platforms such as Instagram, Facebook, TikTok, YouTube, property portals or website providers.
You are responsible for ensuring that your use of the finished content complies with the rules and policies of the platform on which you publish it.
17. Confidentiality
We will treat commercially sensitive information provided to us as confidential and will not knowingly disclose it to third parties except where necessary to provide the services, comply with the law or protect our legitimate business interests.
18. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales, unless applicable law provides otherwise.
